Who you're working with

I'm Helal, an independent engineer based in Dhaka, Bangladesh, working with businesses in other countries. You work with me directly; I don't pass your project to anyone else without your written agreement. These terms apply to every proposal you accept, unless the proposal says otherwise.

How work starts

The discovery call is free, for businesses that qualify through "Start a project". It's a 30-minute video call. I review your site or brief before the call and come with the questions and risks I see.

No paid work starts without a one-page proposal. It sets out the outcome, the scope, the timeline, the price and the payment schedule. Work begins once you accept it in writing. Prices are never published on this site; each proposal is priced for the work it describes.

The offers

• Technical & growth audit. A written audit of code, performance, security, infrastructure and tracking, with a prioritized fix list and expected impact, delivered in 5 business days. Fixed fee.
• Project build. A defined build from a written spec: a feature, integration, plugin, platform or app. Fixed price per project or milestone.
• Ongoing engineering. A set block of development, performance, automation or growth engineering work each month, with a monthly note. Monthly, with a 3-month minimum.
• Site care plan. Monitoring, updates, backups with tested restores, security, speed and priority support. Monthly, in three tiers.
• Emergency fix. A hacked, down or broken site handled first, with a set response time. Fixed fee per incident.

Payments

• Audits are paid before the audit starts.
• Project builds start with a deposit. The rest is invoiced by milestone or on delivery, as the proposal sets out.
• Monthly work (ongoing engineering and site care) is invoiced at the start of each month, for that month.
• Emergency fixes are invoiced once the site is back under control.

Invoices are in the currency named in the proposal and are due within 7 days. I accept international bank transfers and the payment services listed on the invoice; each side pays its own bank and transfer fees. If an invoice is overdue, I send a written reminder, and work may pause until it's paid. Nothing already delivered is taken away.

The audit credit

If you hire me within 30 days of receiving your Technical & growth audit, the full audit fee is credited against that work.

Revisions and changes

The spec is the agreement. I revise the work until it does what the spec says, at no extra cost. A change to the spec itself, a new feature or a different approach, is written up as a change request with its effect on time and price, and starts only once you approve it.

Defects in delivered work, where it doesn't do what the spec says, are fixed at no charge during the support period in your proposal.

Who owns the work

You do, once the work is paid in full. On full payment, the rights to the code, designs, automations and documentation made for you transfer to you. Until then, you may use the work for review and testing.

Third-party and open-source components keep their own licences, and I tell you which ones the work uses. I may reuse general techniques, know-how and tools of my own that aren't specific to your business, never your data, content or anything that identifies you.

Confidentiality

Everything I see while working with you stays confidential: your data, your numbers, your customers and your access. On this site, client work is anonymized by default, for example "US subscription supplement store". Your name, logo or results appear only with your written approval.

NDA

An NDA is available on request, including before the discovery call.

Access and passwords

I never ask for passwords. You add me as a user with my own login on each platform, and you can remove my access at any time. When the work ends, I ask you to remove it.

Your data

When the work involves your customers' personal data, I process it only to do the work you've asked for, keep it within your systems wherever I can, and delete any copy I hold when the work ends. A data processing agreement is available on request.

Ending the work

Either of us can end a project with written notice. You pay for the work done up to that point, and you receive everything made so far. Monthly work can be cancelled with written notice before the next month starts, once the 3-month minimum has passed.

Liability

I take care to test every change and keep a way back. Even so, my total liability for any piece of work is limited to the fees you paid for that work. I'm not liable for indirect losses such as lost profits or lost sales, or for outages and changes at third-party services (hosting, payment gateways, plugins, platforms) that I don't control. Nothing here limits liability that can't be limited by law.

Governing law

These terms are governed by the laws of Bangladesh, unless your proposal names another law. If a disagreement comes up, we'll first try to settle it by talking it through in writing.
